Abstract
The development of artificial intelligence (AI) is increasingly transforming commercial arbitration while creating new regulatory challenges. This article examines the regulatory of European Union (EU) approach to AI in commercial arbitration, with a view to drawing lessons for Vietnam. The article focuses on three key aspects of the EU framework: a risk-based approach to AI regulation, obligations imposed on providers of high-risk AI systems, and specific requirements for providers of general-purpose AI (GPAI) models. The article argues that these mechanisms provide a structured basis for managing the risks associated with AI-assisted arbitral decision-making while maintaining human oversight and accountability. Based on the EU experience, the article proposes relevant considerations for Vietnam in developing a regulatory framework for the responsible use of AI in commercial arbitration.
