Legal responsibility of Business Actors towards Consumers for incompatibility of information on Food Products labeled Gluten Free

Abstract
Rising public awareness regarding food quality has driven high demand for gluten-free labeled food products, particularly among individuals with celiac disease and gluten intolerance. Inaccurate information on such labels poses potential health risks to consumers and creates legal liability for business operators. This normative legal study aims to analyze the forms of legal liability borne by business operators and the avenues for redress available to consumers regarding labeling discrepancies on gluten-free products. The study employs statutory and conceptual approaches, utilizing descriptive-qualitative analysis based on a literature review. The findings indicate that business operators who provide inaccurate gluten-free labeling violate Article 8, Paragraph (1) of Law Number 8 of 1999 concerning Consumer Protection. Based on the principle of presumed liability, business operators are obligated to provide compensation as stipulated in Article 19 of the Consumer Protection Law. Consumers may pursue dispute resolution through litigation (court proceedings) or non-litigation channels (out-of-court settlements), such as through the Consumer Dispute Resolution Agency (BPSK) via mediation, conciliation, or arbitration mechanisms. The study recommends stricter government oversight, the exercise of good faith by business operators, and increased consumer diligence regarding products.
