The Uniform Civil Code represents a significant constitutional issue in India and remains an important subject of legal and public discourse. The concept is closely associated with questions of law, religious freedom, equality, and the protection of individual rights. Article 44 of the Indian Constitution directs the State to work towards establishing a Uniform Civil Code for citizens throughout the country. Such a common legal framework would primarily govern matters concerning personal and family life, including marriage, divorce, inheritance, adoption, guardianship, and other related civil matters. However, India has a rich heterogeneity in its socio-legal fabric and is characterized by its diverse religious as well as communal composition which adheres to their respective diverse personal laws.  In light of the diverse character of Indian society, UCC constitutes a complicated socio- legal problematic. This research paper primarily investigates the dynamics between UCC and constitutionalism especially with reference to family laws of India and in conjunction with constitutional value such as; equality, secularism, freedom of conscience, right of an individual, and gender justice and position of judiciary with regard to resolution of such conflicts arising between personal laws and fundamental rights guaranteed under the Constitution. This paper looks into two opposite perspectives on UCC- for or against- which includes the concern of minority rights, cultural difference, religious freedom, preservation of different practices and traditions. Through a socio-legal approach, this paper argues that reforms should be implemented in family laws following the principles of equality, constitution morality, gender justice and sanctity of pluralistic character of society.
