Commercial arbitration in nigeria after the arbitration and mediation Act 2023: Challenges, reforms and future directions

Abstract
Arbitration has become the preferred mechanism for resolving commercial
disputes because of its flexibility, confidentiality, party autonomy and
enforceability. This article critically evaluates the extent to which the
Arbitration and Mediation Act 2023 addresses institutional, judicial and
procedural challenges affecting arbitration practice in Nigeria. Using
doctrinal and comparative legal methods, it analyses the evolution of
arbitration, contemporary challenges, comparative perspectives, the impact of the
2023 Act and proposes reforms for strengthening Nigeria's arbitration
ecosystem.
