An analysis of acquittal decisions in criminal cases involving juveniles in Aceh

Abstract
The Decision Number 2/JN.Anak/2023/MS.Cag, the Decision Number 10/JN/2025/MS.Jth, Decision of the Lhoksukon Sharia Court Number 24/JN/2022/MS.Lsk are criminal cases against minors based on Aceh Qanun No. 6 of 2014 concerning Jinayat Law and Law No. 11 of 2012 concerning the Juvenile Criminal Justice System. The panel of judges ultimately rendered a verdict of acquittal because the elements of the crime were not proven legally and convincingly. The judge's consideration adhered to the provisions of Article 183 of the Criminal Procedure Code, which requires at least two valid pieces of evidence and the judge's conviction. Normatively, this approach reflects adherence to the negative proof system according to the law (negatief wettelijk bewijsstelsel), but in practice, it seems to place too much emphasis on the formal aspects of proof. This research aims to analyze and explain acquittals in juvenile criminal cases in Aceh. The research method used is normative juridical with approaches of legislation, comparison, case, and conceptual. The data used are secondary data, which are then analyzed qualitatively using deductive reasoning methods to answer the research problem formulation. The research results show that an acquittal is not merely a failure of procedural law, but also an indicator of the need for a paradigm shift in evidence presentation, strengthening judges' capacity to understand the psychology of child victims, and a stronger synchronization between Qanun Jinayat and national legal instruments oriented toward child protection, such as Law Number 35 of 2014 on Child Protection, and Law Number 11 of 2012 on the Juvenile Justice System.
