Human rights enforcement in demonstration handling in a democratic rule of law state

Abstract

This study offers a novel analysis by integrating human rights law with the theory of state–global corporation relations. It focuses on demonstrations in Semarang City within the framework of a democratic rule-of-law state in a normative juridical method with statute, conceptual, and comparative approaches,

specified as descriptive-analytical and prescriptive. Data collection relies on library research, while analysis uses grammatical and systematic interpretation of national legal norms and international human rights standards.

Findings reveal that demonstrations are a constitutional right guaranteed by the law often violates the principle of gradual use of force and results in excessive use of force, making accountability and command responsibility crucial. Moreover, the relationship between the state and global corporations shows a tendency to prioritize strategic investment interests at the expense of local community rights. This integrative analysis produces normative recommendations for the Semarang City Government to strengthen accountability, harmonize national law with international standards, and protect freedom of expression as a pillar of democratic rule of law.
