Unequal access to Online Learning Platforms: Examining How the Digital Divide undermines the implementation of the Right to Education in rural areas

Abstract
The swift transition into digital education
has further compounded the pre-existing disparities on access to education
especially in rural regions where technological infrastructure is still
insufficient. This paper discusses ways in which the digital divide hinders
proper realization of the right to education that is a basic and
internationally acknowledged human right. It examines the legal and policy
framework of educational access, specifically referring to constitutional
provisions, international obligations and digital educational initiatives. It
also examines the structural obstacles, including internet access, internet
illiteracy, and socio-economic differences that influence isolated communities
at a higher rate. Evaluating the effect of disparate access to online education
services, the paper identifies the consequent educational marginalization and
violation of rights. It ends with policy suggestions to close the digital
divide and provide inclusive and equitable access to education in rural settings.
