Concept of corporate criminal responsibility in Indonesia for violations in the placement of Indonesian workers

Abstract
Indonesia has abundant human resources but unfortunately, human
resources in Indonesia lack expertise due to low educational qualifications.
Due to the abundance of human resources, there is a negative correlation with
the employment prospects in Indonesia, resulting in a high number of unemployed
people in every city in Indonesia which makes it inversely proportional to the
employment opportunities in Indonesia. Unemployment in Indonesia is increasing
but there are few jobs and low wages for workers, which makes some people more
interested in finding work abroad, namely by becoming Indonesian Migrant
Workers (TKI). With the number of people who want to become TKI, there are
several criminal acts committed by corporations, namely by committing crimes or
violations in various ways ranging from document forgery, human trafficking to
exploitation. The method used in this research is normative juridical by using
the approach of legislation and case approach. The criminal liability of
corporations involved in sending Indonesian Migrant Workers (TKI) is that
companies that have committed criminal offenses will be prosecuted based on the
form of criminal acts committed and will get sanctions that have been
determined in accordance with applicable laws.
