Juvenile justice and protection of children from sexual offences under POCSO act - A critical study

Abstract
This article provides a thorough analysis of
the POCSO Act and the Indian juvenile justice system through a critical lens,
highlighting their effectiveness in resolving the complex issues pertaining to
both juvenile offenders and victims of sexual offenses. The first section of
the article provides an outline of the important concepts and historical
development of the juvenile justice system, emphasizing the legislative
framework that oversees juvenile justice in India. The POCSO Act’s history and
clauses are then explored, with specific attention paid to important elements
including the age of consent, special courts, and penalties. The POCSO Act and
the juvenile justice system’s actual execution are critically analysed for a
significant amount of the text. The pros and cons of both punishment and
rehabilitation for young offenders are discussed, as well as the difficulties
in determining mental maturity. The POCSO Act’s enforcement concerns are also
thoroughly examined in this article, with particular attention paid to
reporting and registration loopholes, victim assistance networks, and delays in
the administration of justice. The effects on kids and society are examined,
with a focus on the psychological fallout for young victims and the social
obstacles to their recovery. International viewpoints on child protection and
juvenile justice provide a comparative comparison with global norms,
emphasizing best practices and lessons discovered in different legal systems.
Case studies highlight significant incidents covered by the POCSO Act, adding
to the legal precedents and their consequences.
