Food safety and public health in India

Abstract
A considerable disparity in the relationship between food safety and
public health has been observed for a long; nevertheless, the right to health
is recognised as a fundamental right. Insecurity towards food safety still
continues to pose a serious challenge, reflecting government shortcomings in
meeting constitutional obligations to ensure the highest attainable standard of
health for their peoples. However, post-modern jurisprudence established the
relationship between the right to healthy food and public health beyond any
contradiction. In this context, the right to food safety has moved beyond the mere
right to food to promote public health, which involves policy interventions and
legislative framework at different levels to bring about behavioural changes in
individuals. In this regard, despite several judicial approaches to right-based
interpretation of the issue of public health, its effective application has not
been fully witnessed so far in India. This present study aims to describe food
safety in the protection of the right to health and also makes an attempt to
explore the genesis of constitutional as well as a statutory commitment of the
State along with judicial intervention from time to time to provide, promote
and protect public health in India with special reference to the Food Safety
and Standards Act, 2006.
